In light of the ongoing development and implementation of core competencies in bioethics, it is important to proceed with a clear sense of how bioethics knowledge is utilized in the functioning of hospital ethics committees (HECs). Without such an understanding, we risk building a costly edifice on a foundation that is ambiguous at best. This article examines the empirical relationship between traditional paradigms of bioethics theory and actual decision making by HEC members using survey data from HEC members. The assumption (...) underlying the standardization of qualifications and corresponding call for increased education of HEC members is that they will base imminent case decisions on inculcated knowledge. Our data suggest, however, that HEC members first decide intuitively and then look for justification, thereby highlighting the need to re-examine the pedagogical processes of ethics education in the process of standardizing and improving competencies. The authors analyze the impact of human rights conditions on foreign direct investment (FDI). Extant literature in this area raises conflicting expectations. Although the “conventional wisdom” posits that repression creates a stable, compliant, and relatively inexpensive host for FDI, there are contending arguments that the protection of human rights reduces risk and contributes toward economic efficiency and effectiveness. Moreover, the burgeoning “spotlight” regime may also punish firms who locate in repressive regimes. Conceptualizing FDI as a two-part process—the initial decision to (...) invest and the subsequent decision of investment amount—the authors assess human rights as a determinant of FDI. Using a two-stage model, they test their hypotheses across developing countries for the years 1980 to 2003. They find that human rights are a significant determinant of the amount of FDI inflows. The meaningful consideration of cultural practices, values and beliefs is a necessary component in the effective translation of advancements in neuroscience to clinical practice and public discourse. Society’s immense investment in biomedical science and technology, in conjunction with an increasingly diverse socio-cultural landscape, necessitates the study of how potential discoveries in neurodegenerative diseases such as Alzheimer disease are perceived and utilized across cultures. Building on the work of neuroscientists, ethicists and philosophers, we argue that the growing field of neuroethics provides (...) a pragmatic and constructive pathway to guide advancements in neuroscience in a manner that is culturally nuanced and relevant. Here we review a case study of one issue in culturally oriented neuroscience research where it is evident that traditional research ethics must be broadened and the values and needs of diverse populations considered for meaningful and relevant research practices. A global approach to neuroethics has the potential to furnish critical engagement with cultural considerations of advancements in neuroscience. (shrink)

We often have affective responses to fictional events. We feel afraid for Desdemona when Othello approaches her in a murderous rage. We feel disgust toward Iago for orchestrating this tragic event. What mental architecture could explain these affective responses? In this paper I consider the claim that the best explanation of our affective responses to fiction involves imaginative desires. Some theorists argue that accounts that do not invoke imaginative desires imply that consumers of fiction have irrational desires. I argue that (...) there are serious worries about imaginative desires that warrant skepticism about the adequacy of the account. Moreover, it is quite difficult to articulate general principles of rationality for desires, and even according to the most plausible of these possible principles, desires about fiction are not irrational. While gender and race often are considered socially constructed, this book argues that they are physiologically constituted through the biopsychosocial effects of sexism and racism. This means that to be fully successful, critical philosophy of race and feminist philosophy need to examine not only the financial, legal, political and other forms of racist and sexism oppression, but also their physiological operations. Examining a complex tangle of affects, emotions, knowledge, and privilege, The Physiology of Sexist and Racist Oppression develops an understanding (...) of the human body whose unconscious habits are biological. On this account, affect and emotion are thoroughly somatic, not something "mental" or extra-biological layered on top of the body. They also are interpersonal, social, and can be transactionally transmitted between people.Ranging from the stomach and the gut to the hips and the heart, from autoimmune diseases to epigenetic markers, Sullivan demonstrates the gastrointestinal effects of sexual abuse that disproportionately affect women, often manifesting as IBS, Crohn's disease, or similar functional disorders. She also explores the transgenerational effects of racism via epigenetic changes in African American women, who experience much higher pre-term birth rates than white women do, and she reveals the unjust benefits for heart health experienced by white people as a result of their racial privilege. Finally, developing the notion of a physiological therapy that doesn't prioritize bringing unconscious habits to conscious awareness, Sullivan closes with a double-barreled approach for both working for institutional change and transforming biologically unconscious habits. The Physiology of Sexist and Racist Oppression skillfully combines feminist and critical philosophy of race with the biological and health sciences. ABSTRACT:Although prior work has shown that employees with ethical leaders are less likely to engage in deviant or unethical behaviors, it is unknown whetherallemployees respond this way or to the same extent. Drawing on social learning theory as a conceptual framework, this study develops and tests hypotheses suggesting that two follower characteristics—conscientiousness and core self-evaluation—moderate the negative relationship between ethical leadership and workplace incivility. Anglo-American embodiments of poststructuralist and French feminism often align themselves with the texts of either Michel Foucault or Luce Irigaray. lnterrogating this alleged distance between Foucault and Irigaray, I show how it reinscrihes the phallic field of concepts and categories within feminist discourses. Framing both Foucault and Irigaray as exceeding]acques Lacan's metamorphosis of G.W.F. Hegel's Concept, I suggest that engaging their styles might yield richer tools for articulating the differences within our different lives.

This paper examines the conceptual development of the philosophical justifications for tyrannicide. It posits that the political philosophy of tyrannicide can be categorised into three distinct periods or models, the classical, medieval, and liberal, respectively. It argues that each model contained unique themes and principles that justified tyrannicide in that period; the classical, through the importance attached to public life and the functional role of leadership; the medieval, through natural law doctrine; and the liberal, through the postulates of social contract (...) theory. Subsequent analysis of these different models however, reveals that these historical models are unable to provide a sufficient philosophical basis for a contemporary justification of tyrannicide. In Part II, it will be contended that a reinvigorated conception of self-defence, a theme common to all three models, when coupled with the modern notion of universal human rights, may provide the foundation for a contemporary theory of tyrannicide. The connections between the fields of queer theory and continental philosophy are strange and strained: simultaneously difficult and all too easy to ferret out, there is no easy narrative for how the two fields interconnect. Both sides of the relation seem either to disavow or simply repress any relation to the other. For example, despite the impact of Foucault's History of Sexuality, Volume One on early queer theory, current work in queer of color critique challenges the politics and epistemology of (...) placing this text in such a canonical position, particularly for the adamantly anti-foundational field of queer theory. 1 On the other hand, continental philosophy, perhaps in its ongoing beleaguered attempt to form an identity within the analytically dominated discipline of philosophy in the United States, 2 seems largely to ignore the growth of queer theory, despite the provocative and invigorating work on some of continental philosophy's most beloved topics, such as temporality, embodiment, desire, the negative, and radically anti-foundational subjectivity, epistemology, and politics. Setting aside the thorny project of their genealogical connections and disconnections, this essay turns to current trajectories in the field of queer theory, particularly the heated debates about temporality and the future, to indicate how this contemporary scholarship both draws on and exceeds a grounding in continental philosophy. Drawing on several feminist and anti-racist theorists, 1 use the trope of the vampire to unravel how whiteness, maleness, and heterosexuality feed on the same set of disavowals—of the body, of the Other, of fluidity, of dependency itself. I then turn tojewelle Gomez's The Gilda Stories for a counternarrative that, along with Donna Harauiay's reading of vampires, retools concepts of kinship and self that undergird racism, sexism, and heterosexism in contemporary U.S. culture.

This new annotated translation of Chapter Six of Hegel's _Phenomenology of Spirit_, the joint product of a group of scholars that included H. S. Harris, George di Giovanni, John W. Burbidge, and Kenneth Schmitz, represents an advance in accuracy and fluency on previous translations into English of this core chapter of the Phenomenology. Its notes and commentary offer both novice and scholar more guidance to this text than is available in any other translation, and it is thus well suited for (...) use in survey courses. (shrink)

In Sites of Exposure, John Russon draws on the resources of phenomenology to describe how human life, while not having a “given” form specified in advance, nonetheless takes speci????ic shape through practices by which we become committed to certain ways of living. This means that our lives are simultaneously a matter of living with a speci????ic reality—what Russon calls “home”—and having to respond to an outside to which we are “exposed.” I argue here that Russon’s analysis is especially useful for (...) feminist philosophy and its attempt to grapple with the possibility of universal principles of justice across cultural contexts, developing this philosophical framework in conversation with Serene Khader’s efforts to furnish a set of core values for transnational feminist praxis that, while universal in their opposition to sexist oppression, are not imperialist, and with Saba Mahmood’s critique of the parochial character of Western conceptions of freedom. Taking my lead from Robert Talisse and Scott Aikin's distinction between “meaning pragmatism” and “inquiry pragmatism,” and guided throughout by Christopher Hookway's understanding of Peirce, I revisit some of the best-known locuses of both Peirce's meaning pragmatism and his inquiry pragmatism, and conclude that the distinction dissolves in Peirce. For Peirce, the very mechanism for elucidating a concept's meaning, the pragmatic maxim, requires ongoing inquiry. Moreover, in performing an inquiry, we elucidate meaning.

This is the final part of a series of two papers that have examined the conceptual development of the philosophical justifications for tyrannicide. While Part I focused on the classical, medieval, and liberal justifications for tyrannicide, Part II aims to provide the tentative outlines of a contemporary model of tyrannicide in world politics. It is contended that a reinvigorated conception of self-defence, when coupled with the modern understanding of universal human rights, may provide the foundation for the normative validity of (...) tyrannicide in contemporary world politics. The international community has long been affected by the political, philosophical and ethical issues surrounding the practice of tyrannicide, defined as the targeted killing of a tyrant. However, there exists no specific international legal instrument that concerns the practice of tyrannicide, rendering the legitimacy of the practice ambiguous. This paper aims to investigate the issue of tyrannicide and offers a number of speculative arguments concerning its legal-philosophical status. It finds that there are essentially two arms of international legal jurisprudence that (...) may regulate the practice of tyrannicide. The first is largely prohibitive and is based on the derived legal arguments against assassination involving the element ofperfidy, relevant extradition law, provisions in the Hague, Geneva and New York Conventions, and the prohibition on the use of force in the UN Charter. The second position, though far more radical and speculative, is more permissive regarding the moral legitimacy of tyrannicide. This position is based on arguments from the classical international theorists Gentili, Grotius and Vattel, contemporary human rights standards, the principle of humanitarian intervention, the duty to protect, and legal category of hostis hutnani generis. It is argued that though the vast majority of international legal principles are indicative ofthe illegality oftyrannicide, that the practice may nevertheless be philosophically legitimated under humanitarian principles. Following the revival of virtue theory, some moral theorists have argued that virtue ethics can provide the basis for a radical politics. Such a politics essentially departs from the liberal model of the moral agent as an autonomous reason-giver. It instead privileges an understanding of the agent as conditioned by her community, and in the case of social oppression and marginalization, communal virtues may become a vehicle for social change. This essay compares political appropriations of virtue theory by Christian theologian (...) Stanley Hauerwas and secular feminist thinkers Lisa Tessman and Margaret Urban Walker. Hauerwas and feminist theorists both embrace a kind of embodied vulnerability as a political virtue, arguing that it enables more genuine social recognition. The virtue feminist critique is more robust than Hauerwas's, however, insofar as it understands mutual recognition to involve acknowledgment of social difference and the concomitant pursuit of justice. This essay explores Adorno's neglected writings on democracy in the United States, composed in English and directed toward an American audience, to illuminate a democratic theory and practice oriented around the concepts of “democratic leadership,” “democratic pedagogy,” and “democratic enlightenment.” Bridging disciplinary divides, this essay brings the lens of artistic modernism to bear on Adorno's writings on democracy in America to illuminate the distinctive contributions of a political theory that might only appear partial and preliminary when analyzed through the lens (...) of conventional politics. Adorno's understanding of “democratic enlightenment” resonates with the modernist concept of epiphany and represents a translation of artistic modernism to the political realm. Reworking traditional readings of Adorno's politics and his relationship with the United States, this essay reads him as a democratic modernist whose lessons on the meaningful practice of democracy still speak powerfully and practically to Americans today. My dissertation is a genealogical examination of the question of history and historical experience in post-Enlightenment thinking. I examine Kant, Hegel and Foucault to determine both how the Kantian-Hegelian tradition has framed the question of history for us and whether, through the genealogical method of Foucault, philosophical thinking can step outside of that structure. My central argument is against the objectification of history that is performed in Kant and then carried to its fruition in the work of Hegel. I turn (...) to the genealogical method, as developed by Foucault out of the work of Nietzsche, for the possibilities of breaking from this post-Enlightenment Reason and its claims of transcendence to historical experience. ;The social, political and ethical ramifications of these developments frame my dissertation. An examination of post-Enlightenment thinking about history necessarily leads to the questions of historicism, relativism and essentialism in post-Enlightenment ethics. I argue that the genealogical method of Foucault opens a way of thinking about historicism that does not reduce it to the ethical chaos of a pure subjectivism or a solipsistic relativism. This kind of swift dismissal of historicism derives from a post-Kantian objectification of history that places historical phenomena in strict opposition to the "universal and necessary" bases of ethical practices. The genealogical method opens the possibility of escaping these reductions: it enacts a different kind of thinking through its engagement with plural, historical discourses. Showing different performances of reason, many of which do not operate through universal, necessary or formal criteria, genealogical thinking opens the possibility of thinking differently about human reason and its ethical enactments in the world. Both the ethical and epistemic implications of this kind of opening can then lead to ways of re-thinking problems currently facing the work of feminists and social-political philosophers. (shrink)

Through a careful reading of Foucault’s 1979 lectures on neoliberalism alongside Volumes 1 and 2 of The History of Sexuality, I argue that scholarship on both neoliberalism and queer theory should heed Foucault’s framing of both neoliberalism and sexuality as central to biopolitics. I thus offer two correctives to these fields of scholarship: for scholarship on neoliberalism, I locate a way to address the ethical bankruptcy of neoliberalism in a manner that Marxist analyses fail to provide; for scholarship in queer (...) theory, I warn that the longstanding embrace of non-conformity as a mode of resistance to normalization is suspiciously neoliberal. I conclude with the possibility of rehabilitating the concept of jouissance as a non-fungible limit to the enterprising rationality of neoliberalism that, if historicized and especially racialized, might offer a meaningful response to the increasing ethical collapse wrought by the neoliberalization of our lives.
